EW is not acting as a general contractor, subcontractor, architect, engineer, building inspector, code official, surveyor, appraiser, environmental consultant, licensed trade professional, construction manager, owner’s representative, employer, agent, or guarantor of any customer or contractor.
Contractors, subcontractors, estimators, inspectors, consultants, suppliers, and vendors must independently verify all customer-provided information. Contractors must perform their own site visit, inspect the property, confirm measurements, quantities, property and access conditions, identify concealed or changed conditions, confirm labor and material requirements, confirm availability and lead times, verify their own pricing, verify applicable permits, verify code requirements, maintain licenses, maintain required insurance, confirm their own bids, confirm assumptions and exclusions, perform work safely, perform work properly, and correct information they know or should reasonably know is inaccurate.
Contractors may not rely solely on EW-generated information as a substitute for professional judgment, field verification, measurements, inspection, due diligence, contract review, code review, or safety obligations.
EW has no obligation to visit or inspect a property, confirm dimensions or quantities, discover concealed conditions, verify customer or contractor statements, confirm licenses or insurance, confirm bids, determine code compliance or permit requirements, monitor workmanship, safety, progress, or payments, detect omissions, or correct third-party information.
This document was generated using information provided by the customer, contractor, or other authorized users. EW has not independently inspected the property or verified the accuracy, completeness, dimensions, quantities, conditions, prices, bids, qualifications, code requirements, or other information contained in this document. Customers are responsible for supplying accurate and complete information. Contractors are responsible for independently verifying all customer information and site conditions before bidding, purchasing materials, contracting, or performing work. This document is a planning and communication tool only and is not a guaranteed estimate, professional inspection, engineering report, architectural document, construction contract, code-compliance certification, or warranty.
Disputes involving property information, measurements, quantities, bids, pricing, omissions, workmanship, delays, payments, change orders, damages, code compliance, licensing, insurance, safety, or contract performance are solely between the customer, contractor, and participating third parties. Using EW to transmit RFQs, bids, messages, reports, approvals, schedules, change orders, documents, or payment-related records does not make EW a party to the underlying transaction, project, or contract.
To the fullest extent permitted by law, contractors and other service providers must defend, indemnify, and hold harmless EW and its protected parties from claims arising from contractor bids, reports, measurements, quantities, representations, assumptions, exclusions, or omissions, failure to verify customer information, workmanship, supervision, scheduling, safety practices, employees, subcontractors, suppliers, equipment, materials, injury, death, property damage, defective work, delay, code violations, liens, licensing, insurance, contractor-uploaded content, or contractor legal or contractual violations. To the fullest extent permitted by law, contractors release EW from claims arising from their conduct or the conduct of their subcontractors, suppliers, employees, or third parties. EW disclaims all warranties concerning accuracy, completeness, availability, merchantability, fitness for a particular purpose, professional standard of care, code compliance, work quality, and construction results. EW excludes indirect, incidental, consequential, special, exemplary, punitive, and delay damages, lost profits, lost opportunity, increased construction costs, material loss, data loss, and business interruption to the fullest extent permitted by law.
